If Kanye West is sued for his controversial new music video for ‘Famous’ – he’s literally asking for it.

Unless you’ve been living under a very large rock, you’ve no doubt heard Kanye West’s latest controversy involving the rappers love-fest video clip for ‘Famous‘ (watch below).

The clip features the 39-year-old ‘businessman’ and musician naked under the sheets, alongside a bunch of celebrities. That included using naked wax lookalikes to recreate Ray J, Amber Rose, Caitlyn Jenner, Bill Cosby, George W. Bush, Donald Trump, Anna Wintour, Rihanna and Chris Brown.

So will the lack of consent in the use of their naked bodies fly?

Probably not.

Yeezy took to Twitter over the weekend to challenge those featured in his new music clip to “sue me already“. The tweet was later removed after it racked up nearly 40,000 retweets, most likely after lawyers advised him that the invitation wasn’t the smartest business move.

Now it looks like West will get his wish. According to lawyers, he will most likely get sued over the video. Californian law protects against unauthorized uses of a celebrity’s “identity” – such as their look or distinguishing characteristics – to the user’s advantage, either commercially or otherwise, when it results in some kind of harm to the celebrity.

While the First Amendment – freedom of speech – could be cited, this usually doesn’t apply to commercial use. As for the video, fans bought tickets to the event, purchased limited-edition merch, and were led to Tidal to stream the video.

In the case of Taylor Swift, there can be no argument that Kanye wasn’t overtly referring to her. As the video pans over Taylor’s naked sleeping body next to Kanye, the lyrics spit “I feel like me and Taylor might still have sex

As a result, it’s pretty clear celebrities could also have a claim for defamation against West. From all reports, Taylor is horrified that Kanye has included a naked doppelganger of her. A source told HollywoodLife:

“Taylor is livid and horrified. She didn’t know what to do when she heard about what Kanye did. She is bewildered, feels betrayed and is beyond frustrated with Kanye. It is like a complete nightmare.”

Speaking about the video, Kanye told Vanity Fair: “It’s not in support or anti any of [the people in the video]. It’s a comment on fame.” He then insisted his wife has no problem with his controversial lyrics.

He said:

“[I say] a lot of lines other wives would not allow a husband to say. But my wife also puts up photos that other husbands wouldn’t let them put up. One of the keys to happiness in our marriage is we’re allowed to be ourselves.”

Kanye also claimed a number of his famous friends are upset that they don’t appear in the controversial video.
